Oakland officials are weighing a change to the city's real estate transfer tax that would end an exemption for foreclosed properties. Under current rules, most real estate sales in the city generate a transfer tax of up to 2.5 percent of the sale price. Foreclosed properties, however, have been excluded from that requirement, allowing buyers and sellers in those transactions to avoid the payment entirely.
The proposal, known as Measure FF, would eliminate that exemption and require foreclosed property sales to be treated like any other real estate transaction for tax purposes. Supporters argue that the current rule creates an unfair advantage for investors who purchase distressed properties while ordinary homeowners and buyers pay the full tax. They say closing the loophole would bring in additional revenue for city services and make the system more equitable.
Critics of the measure raise concerns about the added cost for buyers of foreclosed homes, many of whom are already dealing with financial strain. They warn that the change could slow the recovery of distressed properties and discourage investment in neighborhoods still working to rebound from the housing crisis.
The debate comes as Oakland continues to look for ways to stabilize its budget and fund core services. Transfer taxes are a significant source of revenue for the city, and how the money is collected has drawn increased scrutiny in recent years. If approved, the measure would apply to future foreclosure sales and could take effect after the required certification of results. Residents will have the final say when the proposal appears on the ballot, with both sides expected to campaign heavily in the coming months.
