A 48-year-old woman from Florida claims her ex-husband concealed more than a third of a million dollars in real estate by using a self-directed IRA during their divorce proceedings. According to court documents, the husband had moved funds from a standard rollover IRA into a self-directed account years before the split. He then used that money to buy two rental properties, with the deeds held in the name of the IRA itself.
The woman told the court she had no idea the properties existed. She only discovered them after a forensic accountant traced a series of small, irregular payments from a joint bank account to a property management firm. The payments covered repairs and property taxes on homes she never knew her husband owned.
The case highlights a growing legal gray area. Self-directed IRAs allow investors to buy physical assets like real estate, but ownership remains with the retirement account, not the individual. This structure can make it difficult for spouses and courts to identify hidden assets during a divorce. The husband argued that since the properties were technically owned by the IRA, they were not part of the marital estate subject to division. The court disagreed, ruling that the funds used to purchase the properties were marital assets and ordering the husband to pay his ex-wife her share. The woman is now seeking additional legal fees and a formal finding of fraud.
